1. Nature of Services
Crestline Advisory (Pty) Ltd ("The Company") provides strategic coordination services for residency applications, property investment, and administrative banking support. By engaging our services, you acknowledge that we act as an intermediary and coordinator, not as a principal in financial or construction transactions.
2. Non-FSP Disclaimer & Fund Handling
Crestline Advisory is NOT a registered Financial Service Provider (FSP) or a Bank.
- No Custody of Funds: We do not hold, custody, or manage client funds at any time. All capital is deposited directly into the Investor's personal account at Standard Bank.
- Payment Authority: Our role is strictly limited to issuing payment instructions based on a written Power of Attorney (POA) and certified milestones (QS Certificates).
- Interest: Any interest accrued in your Money Market account belongs solely to you.
3. FICA & Regulatory Compliance
All transactions are subject to the Financial Intelligence Centre Act (FICA). Clients are legally required to provide:
- Proof of Identity (Certified Passport/ID).
- Proof of Address and Source of Funds.
The Company and its banking partners reserve the right to suspend services or freeze transactions if FICA requirements are not met.
4. Third-Party Liability & NHBRC
The Company coordinates with licensed third parties but is not liable for their independent actions:
- Construction: The Developer (CanvasCrest Properties) is responsible for construction quality and is enrolled with the National Home Builders Registration Council (NHBRC). Structural warranties (5 years) are provided directly by the Developer.
- Banking: Standard Bank is solely responsible for the custody of funds and interest rates.
- Government: Visa/Residency approvals are at the sole discretion of the Department of Home Affairs (DHA).
5. Force Majeure
Crestline Advisory shall not be liable for delays or failures in performance resulting from acts beyond its reasonable control, including but not limited to:
- Acts of God, war, or civil unrest.
- Governmental actions or delays by the DHA/VFS.
- National Power Grid Failures (Load-shedding): Delays caused by extended electricity interruptions affecting municipal or banking systems.
6. Governing Law & Dispute Resolution
These terms are governed by the laws of the Republic of South Africa.
- Any disputes shall first be attempted to be resolved via good-faith negotiation for 30 days.
- Failing settlement, disputes shall be submitted to the exclusive jurisdiction of the Western Cape High Court, Cape Town.
